By accessing or using PickSignal ("the Service"), available at picksignal.ai, you agree to be bound by these Terms of Service ("Terms"). 4. Entertainment Disclaimer

The PickSignal name, logo, and all related names, logos, product and service names, designs, and slogans are trademarks of PickSignal. You may not use these marks without our prior written permission. All other names, logos, and marks are the property of their respective owners.

7. User-Generated Content

PickSignal allows users to submit picks, predictions, and related content ("User Content"). By submitting User Content, you grant PickSignal a worldwide, non-exclusive, royalty-free, perpetual, irrevocable license to use, reproduce, modify, adapt, publish, translate, distribute, display, and create derivative works from your User Content in connection with the Service.

You represent and warrant that you own or have the necessary rights to submit your User Content and that it does not violate any third-party rights, applicable laws, or these Terms. You are solely responsible for the accuracy and legality of your User Content. PickSignal reserves the right to remove any User Content at its sole discretion without notice. We do not endorse, verify, or guarantee the accuracy of any User Content, including submitted picks and predictions.

8. Prohibited Conduct

You agree not to:

Use the Service for any unlawful purpose or in violation of any applicable law
Attempt to gain unauthorized access to the Service, other accounts, or any related systems
Use automated scripts, bots, or scraping tools to access or collect data from the Service without prior written authorization
Interfere with or disrupt the integrity or performance of the Service
Submit false, misleading, or fraudulent picks or user content
Impersonate any person or entity or misrepresent your affiliation with any person or entity
Harass, abuse, or harm other users of the Service
Use the Service to advertise or promote third-party products or services without consent

9. Limitation of Liability

To the maximum extent permitted by applicable law, PickSignal, its officers, directors, employees, agents, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, revenue, data, or financial losses, whether arising from contract, tort, negligence, strict liability, or otherwise, even if PickSignal has been advised of the possibility of such damages.

PickSignal's total aggregate liability for any claims arising from or related to the Service shall not exceed the greater of (a) the amount you paid to PickSignal in the twelve months preceding the claim, or (b) one hundred US dollars ($100). The Service is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement.

10. Indemnification

You agree to indemnify, defend, and hold harmless PickSignal, its officers, directors, employees, agents, licensors, and affiliates from and against any and all claims, liabilities, damages, losses, costs, expenses, and fees (including reasonable attorneys' fees) arising from or relating to: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any rights of a third party; (d) your User Content; or (e) any betting or wagering decisions you make based on information obtained through the Service. This indemnification obligation will survive termination of these Terms and your use of the Service.

11. Termination

PickSignal reserves the right to suspend or terminate your access to the Service at any time, with or without cause, and with or without notice. Reasons for termination may include, but are not limited to, violation of these Terms, fraudulent or illegal activity, extended periods of inactivity, or requests by law enforcement or government agencies. Upon termination, your right to use the Service ceases immediately. All provisions of these Terms that by their nature should survive termination shall survive, including but not limited to ownership provisions, warranty disclaimers, indemnification, and limitations of liability.

12. Changes to Terms

PickSignal reserves the right to modify or replace these Terms at any time at our sole discretion. When we make changes, we will update the "Last updated" date at the top of this page. Material changes may be communicated through a notice on the Service or via email to registered users. Your continued use of the Service after any changes to these Terms constitutes your acceptance of the revised Terms. It is your responsibility to review these Terms periodically for changes.

13. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the United States of America, without regard to conflict of law principles. Any disputes arising from or related to these Terms or the Service shall be resolved exclusively in the federal or state courts located within the United States. You consent to the personal jurisdiction and venue of such courts and waive any objections based on inconvenient forum.

Before initiating any formal legal proceedings, you agree to first contact PickSignal to attempt to resolve the dispute informally. If the dispute cannot be resolved within thirty (30) days of initial contact, either party may proceed with formal legal action.

14. Severability

If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect. The failure of PickSignal to exercise or enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.
